Scope of application

These are the General Terms and Conditions of Inter Protect GmbH, Oberneuhofstrasse 5, 6340 Baar. The company provides paid services relating to the security of persons and goods as well as advice on security issues.
These GTC apply to the above-mentioned areas as well as all other services provided directly or indirectly by the company.

Conclusion of contract

The contract is concluded when the customer accepts the offer, makes a payment or makes use of a service.
By placing an order or using a service of Inter Protect GmbH, the customer automatically accepts the General Terms and Conditions.

Prices

All prices are in Swiss francs (CHF) and exclusive of any value added tax (VAT).
The company reserves the right to change prices at any time. For the customer, however, the prices valid at the time the contract is concluded shall apply in accordance with the offer. An offer expires after three months.
Partial hours are invoiced as such. The minimum charge is 6 hours per start of service.

Payment

The company reserves the right to demand advance payment for certain services. The invoice is issued on the basis of the quotation or the agreed price. Any additional expenses will be invoiced separately.
If the invoice is not paid 48 hours before the service is provided, the company has the right to consider the order as not accepted and not to provide the agreed service.
If the company waives advance payment, the invoice amount must be paid within 14 days of the invoice date. A reminder fee will be charged if payment is not made on time.

Provision of services

The company fulfills its obligation by providing the agreed service. The service includes the services listed on the specific offer, order confirmation or invitation to tender.
The Contractor shall have the right to call in additional personnel to fulfill the contractually agreed obligations.

Obligations of the customer

The customer is obliged to take all precautions necessary for Inter Protect GmbH to provide the service immediately. In addition, he must make the arrangements at the agreed place at the agreed time and to the agreed extent. Depending on the circumstances, this may also include the provision of necessary information and documents.
By accepting these GTC, the customer also confirms that he/she has unlimited capacity to act and is of legal age. By confirming the order (accepting the offer), the customer expressly declares that all information provided is true, complete and up-to-date.

Right of withdrawal

Both parties have the right to withdraw from the contract at any time. Inter Protect GmbH may invoice the expenses already incurred as well as the costs caused by the withdrawal.

Liability

Liability for direct damages is limited to the amount of the Inter Protect GmbH service purchased by the client.
Liability for indirect damage or consequential damage to the object, goods or person to be protected as defined in the contract is rejected in full.
Inter Protect GmbH is also not liable for damage caused by the customer through gross negligence, non-compliance with safety recommendations or intent.
Liability for third parties is also rejected in full.

Data protection

The customer is prohibited from using, publishing or making available to third parties any order-specific information, personal details, data, images, texts and details of the implementation or similar, unless this has been explicitly authorized by Inter Protect GmbH.
Inter Protect GmbH may process and use the data and other information about the customer collected as part of the order.
The customer agrees in full to the use of their data by Inter Protect GmbH.
The data may only be passed on to service partners and authorities involved in the order in order to fulfill the order. All data is treated confidentially.

Changes

These General Terms and Conditions may be amended by Inter Protect GmbH at any time. The GTC in force at the time the contract is concluded shall apply to the customer.

Priority

The GTC take precedence over all other provisions, with the exception of individual provisions that specify and supplement these GTC.
Individual provisions only come into force if this is explicitly stated in the contract.
Should a provision of the contract or a supplement to the contract be or become invalid, this shall not affect the validity of the remainder of the contract.

Confidentiality

Both contracting parties undertake to treat all information confidentially.

The place of jurisdiction

The place of jurisdiction is Zug, Switzerland. Swiss law applies.
